More on Gov. Umahi’s sack
Following their defection from the Peoples Democratic Party, PDP, to the ruling All Progressive Congress, APC, the Federal High Court in Abuja yesterday discharged Governor David Umahi of Ebonyi State and his Deputy, Dr Eric Kelechi Igwe, from their respective offices.
The court also ordered 16 members of the Ebonyi State House of Assembly to resign their seats and repay any wages and funds received from the day they defected to the APC on November 17, 2020.
How the Judge ruled concerning Gov. Umahi
The complete amount of 393, 343 votes Governor Umahi received during the March 9, 2019 governorship election in Ebonyi State belonged to the PDP and could not be legitimately transferred to the APC, according to Justice Inyang Ekwo.
According to the court, when Umahi and his deputy switched to the APC, they not only abandoned the PDP, but also the votes that belonged to it.

According to the conclusion of the governorship election, the plaintiff and no other political party are entitled to the posts of governor and deputy governor in Ebonyi State.
“There is no constitutional provision that allows a ballot to be transferred from one political party to another,” Justice Ekwo continued.
He claimed that the PDP was obligated to keep the votes and mandate granted to it by Ebonyi voters because Governor Umahi and his deputy could not legally transfer them to the APC.
“The 2nd, 3rd, and 4th Defendants have not refuted the Plaintiff’s statement that the 3rd and 4th Defendants became governor and deputy governor of Ebonyi State in 2015 and 2019, respectively, by the Plaintiff’s vote.”

“To summarize, the 3rd and 4th Defendants did not win the election of 9th March 2019 on their own to become governor and deputy governor of Ebonyi State, respectively.”
“They were sponsored by the Plaintiff in accordance with Section 221 of the Constitution of the United States of America, as amended.” As a result, the electorate voted for the Plaintiff (PDP).
“After their defection, they cannot remain in the offices of governor and deputy governor of Ebonyi State without the Plaintiff (PDP) that the voters voted for.”

“On the other hand, the 2nd Defendant (APC) was not the party voted by the public to govern Ebonyi State in the election of March 9, 2019.” Because the APC did not win the election that produced the Governor and Deputy Governor, the 2nd Defendant (APC) cannot administer Ebonyi state through the 3rd and 4th Defendants.
“The Constitution is jeopardized when politicians may blatantly mechanize the will of electorates when they vote for a political party with no consequences.”
“In this matter, the act of the 2nd, 3rd, and 4th Defendants, as well as their respective counsel’s position, is aimed at the political demolition of the 1999 constitution, as amended.” “It has to be stopped right now,” Justice Ekwo declared.
